1. Trader Information

These Terms of Service govern the use of the EPSO Practice website and services.

2. Definitions

  • Service means the EPSO Practice website, platform, educational materials, quizzes, explanations, accounts, and paid access features.
  • User means any person using the Service.
  • Consumer means a natural person acting for purposes outside their trade, business, craft, or profession.
  • Entrepreneur with consumer rights means a sole trader who is granted certain consumer protections under applicable Polish law in cases specified by law.
  • Digital content / digital service shall be understood in line with applicable consumer law.

3. Acceptance of the Terms

By accessing or using the Service, creating an account, or purchasing paid access, you agree to these Terms.

If you do not agree to these Terms, you must not use the Service.

4. Nature of the Service

EPSO Practice provides educational practice materials intended to help users prepare for EPSO competitions and similar exams.

The Service is for educational and training purposes only. We do not guarantee success in any examination, competition, or recruitment process.

We are not affiliated with EPSO, the European Commission, or any EU institution.

5. Technical Requirements

To use the Service properly, you need:

  • internet access,
  • a compatible, up-to-date web browser,
  • a device capable of displaying modern web content,
  • an active email account if account-based access is used.

Some features may require enabling JavaScript, cookies necessary for login, or third-party sign-in functionality.

6. Account Registration and Access

If account registration is required for paid access or progress tracking:

  • you must provide accurate and up-to-date information,
  • you are responsible for maintaining the confidentiality of your login credentials,
  • you are responsible for activity carried out through your account unless caused by our fault,
  • you must notify us promptly if you suspect unauthorized access.

We may suspend or restrict access if we reasonably believe your account is being misused, compromised, or used in breach of these Terms.

7. Free Access

We may offer limited free access to selected questions, materials, or features. We may modify, replace, or discontinue free content at any time.

8. Paid Access, Prices and Contract Formation

8.1 Paid plans

The website currently presents paid access options including Weekly, Monthly, Annual, and Lifetime access. The exact scope, duration, and price of each offer are shown on the website at the time of purchase.

8.2 Contract formation

A contract is concluded when:

  • you place an order,
  • you accept the applicable terms and required purchase disclosures,
  • payment is successfully authorized or completed,
  • and we confirm access or make the paid digital service available to you.

8.3 Prices

All prices shown on the website are gross prices and include VAT where applicable.

8.4 Billing model

Weekly, Monthly and Annual access are one-time purchases granting access for the stated period only. They do not renew automatically unless explicitly stated otherwise at checkout.

8.5 Lifetime access

"Lifetime" means access for the period during which the Service remains commercially operated in substantially its current form, unless a longer commitment is expressly stated by law or by an individual written promise from us. It does not mean guaranteed operation forever regardless of business, legal, or technical circumstances.

9. Right of Withdrawal for Consumers

9.1 General rule

If you are a Consumer, you generally have the right to withdraw from a distance contract within 14 days without giving any reason, unless an exception applies under applicable law.

9.2 Digital content / digital service supplied immediately

If, before the end of the 14-day withdrawal period, you expressly request immediate performance of the digital service or immediate supply of digital content, and acknowledge that you thereby lose your right of withdrawal once full performance begins or the digital content/service is supplied as provided by law, your right of withdrawal may be lost to the extent permitted by applicable law.

9.3 How to exercise withdrawal

To exercise the right of withdrawal, contact us at: contact@epsopractice.eu. You may send an unequivocal statement of withdrawal before the deadline.

9.4 Effects of withdrawal

If withdrawal is valid, we will reimburse payments due in accordance with applicable law and using the same payment method unless otherwise agreed.

9.5 Statutory rights unaffected

Nothing in these Terms limits non-waivable consumer rights under applicable law.

10. Conformity and Complaints

10.1 Our obligation

We are responsible for supplying the Service in conformity with the contract and applicable mandatory consumer law.

10.2 When you may complain

If you are a Consumer or an entrepreneur with consumer rights where applicable, you may file a complaint if:

  • access is not provided as purchased,
  • the Service materially fails to match the described features,
  • the Service has defects or non-conformity covered by mandatory law.

10.3 How to complain

Please include, where possible: your identification details, order or account email, description of the issue, when the issue occurred, and your requested resolution.

10.4 Remedies

Where required by law, remedies may include bringing the Service into conformity, proportionate price reduction, reimbursement, or contract termination, depending on the circumstances and applicable law.

11. Refund Policy

We may, at our discretion, offer goodwill refunds in individual cases. This does not limit statutory consumer rights.

12. License and Permitted Use

Subject to these Terms and payment where applicable, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your own personal, non-commercial educational use.

You may not:

  • resell access,
  • sublicense or commercially exploit the Service,
  • share paid materials publicly,
  • distribute questions, explanations, or databases without permission,
  • remove copyright or proprietary notices.

13. Prohibited Conduct

You agree not to:

  • share account access with others,
  • scrape, systematically extract, copy, or harvest content or data,
  • use bots, automation, or scripts in a way that burdens or bypasses the Service,
  • attempt unauthorized access,
  • interfere with security features,
  • reverse engineer the Service except where mandatory law expressly permits it,
  • use the Service unlawfully,
  • upload or transmit malicious code.

14. Intellectual Property

All intellectual property rights in the Service, including questions, text, explanations, layouts, databases, branding, and software elements, belong to us or our licensors.

Except for the limited right to use the Service in accordance with these Terms, no rights are transferred to you.

15. Updates and Changes to the Service

We may update, modify, improve, suspend, or discontinue parts of the Service for technical, security, legal, or business reasons, in accordance with applicable law and without limiting mandatory consumer rights.

16. Availability

We aim to keep the Service available and functioning properly, but we do not guarantee uninterrupted or error-free operation at all times. Temporary downtime may occur for maintenance, updates, security issues, third-party outages, or events beyond our reasonable control.

17. Third-Party Providers

Some parts of the Service may rely on third-party providers, such as hosting, authentication, or payment processors. We are not responsible for the separate terms or privacy practices of those third-party services, but we remain responsible to consumers to the extent required by mandatory law for the service we sell.

18. Termination and Suspension

We may suspend or terminate access if:

  • you materially breach these Terms,
  • your use poses a security or legal risk,
  • payment is not completed or is reversed,
  • continued provision is not possible for legal or technical reasons.

You may stop using the Service at any time.

19. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is unlawful, including liability for fraud, wilful misconduct, death or personal injury caused by negligence where non-excludable, or violation of mandatory consumer rights.

Subject to the above, to the maximum extent permitted by law: the Service is provided on an "as available" basis; we do not guarantee that the materials will exactly reflect current EPSO exam formats or outcomes; our liability for non-consumer claims is limited to the amount paid by you for the relevant Service in the 12 months preceding the event, unless mandatory law requires otherwise.

For consumers, mandatory statutory rights prevail.

20. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including infrastructure outages, acts of public authorities, war, cyber incidents of extraordinary nature, labour disputes, or force majeure events.

21. Complaints and Dispute Resolution

We do not commit to participating in out-of-court dispute resolution unless required by applicable law. Consumers may nevertheless use available consumer-protection or ADR mechanisms in their country where applicable.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland, except that if you are a Consumer residing in another EU/EEA country, you also retain the protection of mandatory provisions of the law of your country of habitual residence where such protection cannot be derogated from by contract.

Any disputes shall be submitted to the competent courts under applicable law. This does not limit any mandatory rights of Consumers regarding jurisdiction.

23. Changes to These Terms

We may update these Terms from time to time for legal, technical, operational, or business reasons. The current version will be published on the website with the updated date. Material changes may also be communicated by email or through the Service where appropriate.
